The Netherlands Gaming Authority (KSA) has announced revised liability gaming policy rules to strengthen the safety of the online gambling market.

Major changes include mandating real-time monitoring of gambling behavior and introducing limits on financial deposits. These adjustments follow KSA research reports and consultations with industry stakeholders.

The new policy, which takes effect immediately, requires online gambling providers to conduct real-time monitoring to detect, analyze and intervene within an hour if there are signs of excessive gambling or potential addiction. The requirement is applicable 24/7 to ensure timely intervention and to prevent gambling-related harm.

In addition, the policy introduces a financial deposit limit for athletes. Teenagers between the ages of 18 and 24 will have a monthly deposit limit of 300 euros ($325), while those over 24 will have a limit of 700 euros.

The provider must verify the ability of the player to gamble further before allowing deposits beyond these limits. If the player is determined to be unable to pay the additional deposit, the provider must block the additional deposit for the remainder of the month.

The revised policy is based on the September 2023 KSA research report, indicating that some providers are not adequately fulfilling their duty of care for timely interventions, especially against excessive gambling.

The policy also reflects recent changes in advertising rules, such as the Orca decision and the ban on the use of role models in gambling advertising.

To ensure the feasibility of the new policy, KSA conducted consultations with stakeholders, including providers, trade associations, and addiction experts, and reviewed 33 comprehensive responses primarily focused on addiction prevention.

While most provisions of the policy come into force immediately, certain provisions relating to the financial deposit limit come into force on October 1, 2024. These delays allow providers to free up the necessary IT adjustment time and hire additional staff.

In May 2024, the KSA announced stricter measures against illegal gambling machines, requiring operators to correct violations within two weeks. The enforcement complies with slot machine operating licenses and ensures safety measures against gambling addiction and underage gambling.

The KSA has also implemented a role model ban on gambling advertisements with the aim of protecting young people. Two sports betting sites were recently reprimanded for violating the ban for using famous soccer players and famous actors to promote.
